III. Additional Information

 

A. Time for Starting and Completing Project

Work shall commence within the last occur of the following:

1. Received a down-payment of 50% of total project cost (IF PROJECT COST EXCEED OVER $1,000.00 )

 

B. Delays

 

  Sunrise multi-service LLC. agrees to start and diligently pursue work through to completion, but shall not be responsible for Delays for any of the following reasons:

1. Strikes, lockouts, boycotts, or other labor union activities, if relevant;

2. Acts of public enemy, terrorists, riots, or civil commotion;

3. Extra work ordered by Owner(s) will be billed on invoice.

4. Unforeseen conditions at the remodeling site;

5. Failure of Owner(s) to make payments as set forth in the Payment Schedule;

 

C. Contract Price

 

Owner(s) shall pay Sunrise multi-service llc. in accordance with the following attached payment schedule.  It is understood that the price agreed upon herein does not include the possible expense entailed in coping with hidden or unknown contingencies found at the job site.  In the event such contingencies arise and the Sunrise multi-service llc. is required to furnish labor or materials or otherwise perform work not provided for or contemplated by Sunrise multi-service llc., the actual cost thereof will be paid for by the Owner.  Should contingencies arise as described above, Sunrise multi-service llc. will notify the Owner, provide an estimate of corrective action, and obtain the Owner’s approval for corrective action. Sunrise multi-service llc. may request payments in advance of the payment schedule to cover for labor and materials if any hidden or unknown contingencies were to arise.

 

 

D. Warranty

 

Sunrise multi-service llc. provides a one (1) year warranty for labor.  Owner must inform Sunrise multi-service llc. in writing of any warranty claims.  Any such warranty shall become effective at time when final invoice is issued (provided all payments due to Sunrise multi-service llc. have been paid within 30 days of final invoice). Any product furnished by client must be on-site and available at time of job start.  Sunrise multi-service llc. will only warranty labor on those products installed by Sunrise multi-service llc. or Sunrise multi-service llc.’s authorized employees and representatives.  Any additional labor required by FIRM due to defective client-furnished labor or products will be at an additional charge based on time and materials. Sunrise multi-service llc. shall provide manufacturers’ warranties at time of final payment.

 

E. Disputes

 

Owner must communicate Sunrise multi-service llc. in writing, text, e-mail, phone, call of any problems with the work and give Sunrise multi-service llc. a reasonable time to cure such problem.   Failure to notify Sunrise multi-service llc. in writing of any problem within seven (7) days from the discovery of such problem by Owner shall be considered a waiver of such problem.

 

F. Default

 

If Owner shall fail to pay any sum of money on the date due, Sunrise multi-service llc. may suspend work and withhold purchased equipment or materials.  If Owner fails to pay any sum due within seven (7) days of project completion, Sunrise multi-service llc. at its option may terminate this agreement and keep monies paid to Sunrise multi-service llc. for purchased material, as well as pursue any sums owed by owner. A late fee of ten percent (10%) shall apply to any payment not paid when due. Owners agrees that upon signing contract, either before or after acceptance by contractor, to be bound thereby and in event of a breach of this contract by said owner =, Contractor shall be entitled to full compensation for work performed, loss of profit and in event of legal dispute all costs and reasonable attorney’s fees, and in no event shall contractor’s recovery be less than 20% of the contract sum.

 

G. Cancellation

 

In the event that the Owner cancels this agreement prior to commencement of construction, Sunrise multi-service llc. shall receive compensation from the Owner for the expenses incurred such as material purchased and profit lost.

 

 

 

 

H. Risk

 

Owner understands that construction sites may carry some risk of personal injury and property loss, and will not hold Sunrise multi-service llc. liable for such injury or loss unless caused by the gross negligence of Sunrise multi-service llc..  Sunrise multi-service llc.is insured and licensed (VA STATE CONTRACTOR LICENSE NUMBER: #2705131337)

 

I. Entire Agreement

 

This Contract contains the entire agreement between the parties, and supersedes all agreements, wRITTEN OR ORAL, the entire Agreement and have received a completed copy.  PREVIOUSLY made between the parties relating to its subject matter.  There are no other understandings or agreement between them, except as otherwise provided herein.  The parties hereby acknowledge that they have read

 

Payment schedule:

 

50% upon acceptance

50% due upon completion

 

Owner's Acceptance:

The above prices, specifications and conditions are satisfactory and are hereby agreed to.  Sunrise multi-service llc.is authorized to do the work as specified at said premises owner will make payment as outlined above.

This proposal may be withdrawn if not accepted within 15 days.
